1. Agreement to Terms

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Kitchen Sync mobile application ("App") operated by Kitchen Sync ("we", "our", or "us").

Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.

2. Account Registration

To use certain features of the App, you may be required to register for an account. You can register using:

• Your email address and a password
• Your Google account

When you register, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to disable any user account at any time if, in our opinion, you have failed to comply with any of the provisions of these Terms.

3. Services Description

Kitchen Sync provides a platform for users to:

• Track kitchen inventory
• Manage expiry dates of food items
• Create and manage shopping lists
• Save favorite items for quick addition to inventory
• Discover recipes based on available ingredients

We use Supabase, a secure database platform, to store your data and provide authentication services. Your data is stored securely and used only to provide you with the App's functionality.

4. User Responsibilities

As a user of the App, you are responsible for:

• Maintaining the confidentiality of your account information
• Ensuring the accuracy of the data you input into the App
• Using the App in compliance with all applicable laws and regulations
• Not using the App for any illegal or unauthorized purpose
• Not attempting to interfere with or disrupt the operation of the App

You acknowledge that Kitchen Sync is not responsible for the accuracy of expiry dates or food safety information. The App is designed to help you track this information, but you should always use your own judgment regarding food safety and consumption.

5. Content

Our App allows you to post, link, store, share, and otherwise make available certain information, text, graphics, or other material ("Content"). You are responsible for the Content that you post on or through the App, including its legality, reliability, and appropriateness.

By posting Content on or through the App, you represent and warrant that:

• The Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms
• The posting of your Content on or through the App does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person

6. Intellectual Property

The App and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Kitchen Sync and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Kitchen Sync.

7. Subscription and Payments

Currently, Kitchen Sync is offered as a free service. However, we may introduce premium features or subscription plans in the future. If we do, we will update these Terms to include payment terms and conditions.

Any future subscription fees will be clearly communicated before you are charged, and you will always have the option to cancel your subscription before being charged.

8. Third-Party Services

The App may contain links to third-party websites or services that are not owned or controlled by Kitchen Sync. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

We use the following third-party services:

• Supabase: For database storage and authentication services
• Google Authentication: For sign-in services

You acknowledge and agree that Kitchen Sync shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App or delete your account through the App settings.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Limitation of Liability

In no event shall Kitchen Sync, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your transmissions or content
• Food safety issues or incidents related to the use of the App

This limitation applies whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

11. Disclaimer

Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Kitchen Sync does not warrant that:

• The App will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The App is free of viruses or other harmful components
• The results of using the App will meet your requirements

Kitchen Sync is not responsible for the accuracy of food expiry dates or safety information. Users should always use their own judgment regarding food safety.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.
